Lawsuit Following Tragic Incident Involving Young Girl



A wrongful death lawsuit has been initiated by the law firm Berman & Simmons against Franklin Sports, Inc., stemming from the heart-wrenching incident that led to the death of six-year-old Lucy Morgan. On June 1, 2024, while the Morgan family was enjoying their final day of a summer vacation at a lake house in Limerick, Maine, an unfortunate accident occurred that would change their lives forever.

According to the lawsuit, Lucy was present in the yard with her young brother while her older siblings engaged in a game of badminton. Tragically, while swinging her racket, Lucy's brother inadvertently hurled the head of the metal badminton racket along with its shaft into the air after they disconnected during play. The exposed metal component struck Lucy in the temple, penetrating her skull.

Emergency services promptly airlifted Lucy to the Maine Medical Center, where doctors fought to save her life. Despite their best efforts, Lucy succumbed to her injuries several days later, on June 5, 2024. The badminton equipment in question was furnished as part of the family’s rental cottage, branded and manufactured by Franklin Sports.

The legal complaint alleges that the racket was not only defective but also posed an unreasonable danger. It specifies that the connection between the handle and the metal stem was insufficiently secured, that the adhesive used was faulty, and that no secondary mechanisms were in place to prevent the metal sections from detaching and posing a threat during standard usage.

Moreover, the lawsuit claims that Franklin Sports neglected to adequately warn consumers about the potential dangers associated with the racket's structural integrity.

Witnesses to this traumatic event included Lucy's three siblings, who were left in shock, while their parents rushed to assist Lucy upon hearing her screams. The legal action aims to seek compensation on behalf of Lucy's estate as well as her siblings, who were emotionally impacted by witnessing the incident. Claims incorporate aspects such as strict liability, negligence, breach of warranty, wrongful death, and survival claims.
