NAELA Highlights Special Needs Law at Stetson University Conference
The National Academy of Elder Law Attorneys (NAELA) recently underscored the importance of special needs planning at the Stetson University College of Law’s National Conference on Special Needs Planning and Special Needs Trusts, which took place from October 22-24, 2025, in Tampa, Florida. As a leading organization dedicated to serving older Americans and individuals with disabilities, NAELA addressed critical issues surrounding special needs law during an event aimed at legal professionals specializing in this area.
During the conference, NAELA distributed a consumer fact sheet that contains five essential elements for effective special needs planning. These resources are designed to empower individuals with disabilities and their families to navigate the complexities of legal and financial matters more confidently. Eric Einhart, NAELA's President, along with other key leaders, participated in discussions highlighting the significance of thoughtful legal planning, described as vital for creating security and opportunities for affected individuals.
"Special needs planning goes beyond just the legalities; it embodies the respect, independence, and voice of individuals with disabilities, along with the quest to support their families," said Alexander T. Graham, NAELA’s CEO. His personal insights as both a child of a deaf adult and a parent of a child with disabilities emphasize the critical role such planning plays in fostering a secure future for families.
Context of the Conference
The timing of this conference, held during Special Needs Law Month, served to increase awareness of the crucial work that special needs law attorneys contribute to society. The event included various sessions focusing on the legal obligations and rights of individuals with disabilities, showcasing a collaborative approach between NAELA and the Special Needs Alliance (SNA).
On top of educating attendees, NAELA and SNA launched a consumer resource titled "5 Things You Need to Know About Special Needs Planning." This document aims to clarify the complexities associated with special needs planning and provides practical guidance that prioritizes financial security and legal protection. Some of the highlights of the resource include:
- - Understanding how traditional inheritance can negatively impact benefits.
- - Recognizing that while Special Needs Trusts are crucial, they are not sufficient on their own.
- - Advocating for early planning and regular review of plans to adapt to changing circumstances.
- - Ensuring that comprehensive planning respects an individual’s autonomy and decision-making power.
- - Encouraging families to seek help and support from professionals, rather than navigating these challenges alone.
Legal Resource Overview
Additionally, NAELA and SNA produced an "Explainer" document outlining the implications of the One Big Beautiful Bill Act on individuals with disabilities. This resource aims to back attorneys working in special needs law with practical guidance, allowing them to advocate effectively for their clients.
With extensive over 4,000 members and 33 active state chapters, NAELA continues to be a critical resource for elder and special needs law attorneys, offering vital education, advocacy, and community support. The remarkable discussions during the conference not only highlighted legal strategies but also fostered a network of professionals committed to making a difference in the lives of individuals with disabilities.
