In a groundbreaking decision, U.S. Customs and Border Protection (CBP) has ruled in favor of domestic manufacturers of freight rail couplers (FRCs), determining that The Greenbrier Companies, Inc. had illegally evaded antidumping duties on its imports from China and Mexico. This ruling is a significant boost for U.S. manufacturers, who have long advocated for fair trading practices in the freight rail industry.

The Findings



The investigation, initiated under the Enforce and Protect Act (EAPA), looked into allegations against Greenbrier regarding its entry of freight rail couplers into the United States without paying the required tariffs established by existing antidumping orders. After a thorough examination, CBP’s Trade Remedy Law Enforcement Directorate concluded that there was substantial evidence suggesting that Greenbrier failed to comply with the lawful entry requirements and improperly claimed exemption from duties.
