Settlement Reached in Class Action Lawsuit Against Costa Sunglasses for Florida Consumers

Costa Sunglasses Settlement Announcement

In a significant legal development for sunglasses buyers in Florida, a class action lawsuit has resulted in a $21.75 million settlement against Costa Del Mar, Inc. This settlement pertains to allegations that Costa engaged in misleading practices regarding repair fees for their sunglasses. The court has authorized this notice, and it aims to inform affected consumers of their rights and available options.

Background of the Lawsuit

The lawsuit asserts that Costa promised to repair sunglasses for a very low fee, a claim that was reportedly false, unfair, and potentially misleading to average consumers. More specifically, it alleges that Costa violated the terms of its warranty by charging customers more than a reasonable fee for repairing sunglasses damaged through accidents, normal wear and tear, or misuse. While Costa denies any wrongdoing, the settlement aims to compensate eligible consumers.

Who Is Included in the Settlement?

The settlement class encompasses all Florida residents who purchased non-prescription and non-promotional Costa sunglasses for personal use between July 28, 2013, and January 31, 2018. Furthermore, it also includes individuals who incurred fees for the replacement of damaged components of their Costa sunglasses during the period from July 28, 2012, to January 26, 2025. This latter group is referred to as the Repair Class, while those who made standard purchases fall under the Purchase Class.

Benefits of the Settlement

For those qualifying under the Repair Class, a pro rata cash payment will be distributed based on their eligible repairs exceeding $11.95. The allocation will be made from the total settlement fund, which designates $6.375 million for the Purchase Class and the remainder for Repair Class members.

Members of the Purchase Class can file a claim via a detailed process outlined on the official settlement website or send documentation through the mail by January 11, 2027. To qualify for a cash payout from the fund for more than five purchases, supporting documentation may be required.

Payment and Options

Eligible consumers can choose how they wish to receive their payment—options include checks, Venmo, PayPal, or Zelle. It’s important to note that if individuals do not want to participate in this settlement, they can opt out by submitting a request by January 19, 2027. If they don't opt out, they relinquish their right to pursue legal action against Costa regarding this issue, which means they will be bound by the court's decisions and any potential judgments.

Important Dates

A final approval hearing is scheduled for March 23, 2027, which will address the approval of the settlement as well as the request for attorneys' fees amounting to $7.303 million. This hearing is open for affected consumers who wish to voice their objections, though attendance is not mandatory.

This settlement not only seeks to provide financial restitution for consumers but also addresses bigger concerns surrounding misleading advertising and consumer rights in the retail optical industry. As more consumers become aware of their rights regarding these issues, this case stands as an important milestone in consumer protection law.
