New Treasury Regulations Empower Solar Developers
In a significant shift for the solar industry, recent updates to Treasury rules have provided an essential lifeline for solar developers across the United States. The elimination of the 5% spend test, coupled with the introduction of new requirements related to physical work, has allowed developers to maintain the eligibility of over 380 MW of projects under the GameChange Balance of System (BOS) solutions.
Overview of the Treasury Changes
The revised Safe Harbor guidance dictates that physical work must be completed by the end of this year for projects that utilize equipment classified as Foreign Entity of Concern (FEOC). For all other projects, an extended compliance window is granted from January 1 to July 4, 2026. This change is particularly critical as many solar projects await necessary utility, environmental, or local approvals prior to commencing construction. The implications of these restrictions could be substantial, creating hurdles for developers who rely on maintaining certain timelines to secure tax credits.
