New York Introduces Groundbreaking Allergen Labeling and Epinephrine Legislation for Enhanced Food Safety

New York's Landmark Allergen Labeling Legislation



In a monumental move for food safety, New York Governor Kathy Hochul has officially signed into law two crucial bills that address the needs of over 2 million residents dealing with life-threatening allergies. The first bill, designated A6558, mandates that pre-packaged food items sold on-site must prominently display labels for the top nine allergens. This groundbreaking legislation is a first in the nation and is expected to significantly enhance consumer safety and awareness during food purchases.

The introduction of A6558 stemmed from the advocacy efforts of Jared Saiontz, an 18-year-old from Westchester County, who took his concerns to prominent lawmakers including Senator Pete Harckham and Assemblymember Jen Lunsford. Thanks to their support and the collective efforts of advocates nationwide, this law will strengthen protections for individuals with food allergies, potentially preventing life-threatening situations in the dining environment.

Jared Saiontz expressed his gratitude for the support he received from the legislators, stating, "Because of your sponsorship of the allergen labeling bill, New York now requires the top nine allergens to be listed on foods prepackaged on-site—a huge step forward for me and for over 2 million New Yorkers living with food allergies."

Moreover, Nurah Shabazz, a 12-year-old from Monroe County, added, "It's amazing to see our voices turn into real change. Together we just created a safer place to live. Advocacy truly works when we stand up with each other."

The second significant piece of legislation, A05392, expands the definition of epinephrine within New York State law. It broadens the scope of what qualifies as an epinephrine delivery device, including new products currently available on the market and those anticipated in the future. This law will enhance emergency anaphylaxis training programs and enable various entities, including schools, to be equipped with the latest epinephrine products.

Sponsored by Assemblymember Linda B. Rosenthal and Senator Andrew Gounardes, this legislative change acknowledges innovative delivery methods such as Neffy and upcoming products like Anaphylm. As emphasized by advocates like Lucia Zaremba, this legislation ensures that communities have access to the most effective treatment options for anaphylactic emergencies, responding to the dynamic nature of scientific advancements in allergy management.

"This new law just brings all of the existing laws up-to-date with current scientific advancements," remarked Jill Mindlin, a New York State advocate. "When we had passed laws in the past regarding epinephrine, we had no way of knowing what future advances would bring."

The passionate advocacy from various groups, including Allergy Advocates New York, has been pivotal in pushing these bills through to legislation.
