Overview of the Thinkware Dashcam Settlement
In early September 2026, the court approved a notice regarding a class action lawsuit involving Thinkware Systems USA, Inc. This announcement was authorized by the California Superior Court in the ongoing case of
Jessica Ratzak, et al. v. Thinkware Systems USA, Inc. The lawsuit alleges that Thinkware misrepresented the capabilities of various dashcam models, particularly their advertised "Super Night Vision" feature, implying that it was applicable at all times when it was actually only available in parking mode. Although the company denies any wrongdoing, they have chosen to settle the case to avoid further legal complications.
Who is Affected?
If you have purchased any of the following Thinkware dashcam models within the United States between
January 25, 2019 and
August 31, 2024, you might be eligible for benefits from this settlement:
- - Thinkware X700
- - Thinkware F200PRO
- - Thinkware DC-M2-FG-IR
- - Thinkware DC-M2-FG
- - Thinkware F70PRO
What Are the Benefits?
As part of the settlement agreement, a fund totaling
$850,000 has been established. This fund will support financial compensations to settlement class members who submit valid claims. It will also cover attorney fees and award a service fee of up to
$10,000 to the class representative. Claims will be distributed on a pro-rata basis depending on the number of valid claim forms submitted and the number of products claimed.
How to File a Claim
To ensure you receive a part of the settlement, you are required to complete and submit a Claim Form. Here’s how:
1.
Online Submission: Navigate to the Settlement Website,
www.TWCameraSettlement.com, to fill out the Claim Form.
2.
Mail Submission: Alternatively, you can print the Claim Form and send it via mail to
Thinkware Claims Administrator, PO Box 1349, Baton Rouge, LA 70821.
3.
Deadline: All Claim Forms must be submitted online or postmarked by
December 14, 2026.
Alternative Actions
If you wish to opt-out of the settlement, you can fill out an
Opt-Out Form by the deadline of
November 30, 2026. Opting out means you will not receive any compensation but retain the right to pursue legal action independently regarding any relevant claims.
Objecting to the Settlement
Class members also have the option to file an objection. If you disagree with any part of the settlement, you can submit your objections to the Court by
November 30, 2026. You may choose to attend the
Final Fairness Hearing on
January 12, 2027, at the Superior Court of California, where the fairness of the settlement will be evaluated and any objections heard.
Important Final Note
If you do not engage with the settlement process, you will automatically become a class member bound by the terms of the agreement and related judgment. Importantly, failing to submit a Claim Form on time will forfeit any right you have to partake in the settlement fund.
