Important Class Action Settlement Notice
A class action lawsuit has been initiated against
Therapeutic Health Services (THS) due to a significant data breach that reportedly occurred on or around
February 26, 2024. This breach allegedly resulted in unauthorized access to the personal information of THS's current and former patients as well as employees. The court case is titled
Kersey, et al., v. Therapeutic Health Services, Case No. 24-2-17679-9 and has received approval from the King County Superior Court.

What Does the Settlement Include?
The proposed settlement involves a
Settlement Fund of $790,000, which is earmarked to compensate individuals for various losses related to the breach. Here’s what is included in the settlement benefits:
- - Out-of-Pocket Losses: Up to $5,000 can be reclaimed for documented expenses that were incurred due to the data breach.
- - Cash Payment: A cash payment of up to $100, subject to adjustments based on the claims submitted.
- - Credit Monitoring Services: Three years of complimentary credit monitoring across three credit bureaus to help protect against identity theft.
To receive these benefits, individuals must submit a valid claim. Failure to do so will result in ineligibility for the compensation.
How to Submit a Claim
Settlement Class Members must fill out a Claim Form, which can either be submitted online at
www.THSDataSettlement.com or mailed to the Settlement Administrator. The completed form must be postmarked by
January 13, 2025. This step is crucial, as no claim means no benefits.
Exclusions and Objections
By submitting a Claim Form, participants agree to forfeit their right to sue THS regarding the issues addressed in this settlement. If you wish to retain your right to pursue your claims independently, you must formally exclude yourself from the settlement, although doing so will forfeit your eligibility for any settlement benefits. The deadline for exclusions or objections is
December 15, 2025. Notably, those who fail to make any claims will remain in the class, surrendering their rights without entitlements to any settlement benefits.
Court Approval Status
As of now, the settlement is pending final approval from the court, which is scheduled for a hearing on
January 23, 2026, at 9:00 AM PT. During this hearing, the court will evaluate whether the agreement is fair and appropriate. Furthermore, the court will consider reasonable fees for attorneys and service awards for Class Representatives. Individuals can choose to appear and express their opinions at this hearing, though attendance is not obligatory to gain settlement benefits.
