Lawsuit Filed After Autistic Child Leaves School Unattended, Sparks Safety Concerns
In a troubling development in Lexington, Kentucky, a family has taken legal action following a serious incident involving their seven-year-old child with autism. The child, referred to as P.W., is the subject of a lawsuit filed in Fayette Circuit Court against the Fayette County Board of Education and several staff members of Meadowthorpe Elementary School. The allegations state that on November 17, 2025, P.W., who is predominantly nonverbal, managed to leave his moderate-to-severe disabilities classroom unaccompanied. At around 1233 PM, the child exited the school through an open window that had reportedly been a point of concern prior to the incident. It is alleged that staff members were completely unaware of his absence when he left the building.

According to him, "When a child with known supervision needs is able to leave a classroom, exit a school building, and ultimately reach a major roadway without anyone realizing it, that represents a serious breakdown in the systems designed to protect students."
Following his departure from the classroom, P.W. was unsupervised for approximately 40 minutes. During this time, he roamed the school grounds until he found a hole in the fence that separated the school property from New Circle Road, a busy thoroughfare in Lexington. He crawled through the hole and was seen running along the road, which was an active construction site at that moment.
Concerned passersby alerted authorities when they spotted the young boy alone in such a hazardous location. Fortunately, personnel from Lexington Animal Care and Control arrived on the scene to ensure his safety before police could intervene. Attorney Justin Peterson remarked, "This situation could have ended in tragedy. The fact that this child was ultimately found safe is due to the intervention of strangers and first responders — not because the school realized he was missing."
The lawsuit further claims that the window involved in the incident had been previously marked for safety upgrades, and staff had requested that a lock be installed to prevent similar occurrences. However, this request had not been addressed in a timely manner, leaving the window unsecured. The school classrooms are equipped with emergency communication tools, but none were utilized during the critical time period after P.W. was found missing.
"Children with developmental disabilities often require additional safeguards and supervision," added attorney Kaci Christopher, who also advocates for the child's family. "Families deserve to know that when their child is entrusted to a school's care, reasonable protections are in place to keep them safe."
In response to the incident, Child Protective Services conducted an investigation, leading to findings of abandonment, supervisory negligence, and threats of physical abuse.
