Slager Madry LLC has recently initiated a federal civil rights lawsuit against the Town of Waterford and seven officers from the Waterford Police Department, following a distressing encounter in September 2024 that left 19-year-old Donovan Beard with severe injuries resulting in quadriplegia. During the incident, Donovan, who has autism, was riding a motorbike when police engaged in a pursuit involving multiple vehicles. Rather than de-escalating the situation, officers used aggressive tactics that ultimately led to a horrific crash. The lawsuit alleges that the police were fully aware of Donovan’s disability as they pursued him into a private residence and unleashed a police dog—actions which intensified his fear and caused him to flee. Tragically, an officer's abrupt intervention left Donovan crashing head-first into a parked police cruiser, resulting in immediate signs of a spinal injury.
Despite clear indications of injury, the police officers failed to provide timely medical assistance. Instead of immobilizing his neck or calling for emergency medical services, they opted to use a taser on Donovan while he lay motionless on the ground. Further actions included rolling him over and dragging him along the pavement—decisions that compounded his injuries. This resulted in a complete and unstable fracture of his cervical spine, leaving Donovan wheelchair-dependent and in need of ongoing, comprehensive care.
Attorney Joaquin Madry, representing Donovan's family, emphasized the grave issues of police escalation and the need for law enforcement to apply appropriate de-escalation techniques, particularly in interactions with those who are developmentally disabled. "This case not only illustrates the failings of the police in this interaction but also raises broader concerns about the treatment of vulnerable individuals by law enforcement," he stated.
In light of the situation, the plaintiffs are seeking a sum of at least $50 million in compensatory damages, punitive damages, and coverage for attorney's fees.
