C.A.R.-Backed Organization Takes Legal Action Against California Cities



In an effort to tackle California's impending housing crisis, a nonprofit organization known as Californians for Homeownership, backed by the CALIFORNIA ASSOCIATION OF REALTORS® (C.A.R.), has initiated legal proceedings against three prominent California cities: San Diego, San Francisco, and Montebello. The lawsuits challenge these municipalities' attempts to impose restrictions on housing developments close to public transit, which contradict the provisions of a significant state law, Senate Bill 79, enacted in 2025.

The Heart of the Issue



The core of these legal actions revolves around the claim that cities must adhere to the regulations established by the California Legislature concerning housing development. Tamara Suminski, the President of C.A.R. and a seasoned real estate professional in Southern California, emphasized the necessity for uniformity in how cities across California comply with housing laws. "Cities throughout California must play by the same set of rules established by our Legislature for the development of housing," said Suminski.

The Crucial Role of Senate Bill 79



Senate Bill 79 was implemented to facilitate housing developments within half a mile or a quarter mile from major transit stations. Under this law, housing projects that meet specific criteria are permitted in areas designated for residential, mixed, or commercial use. However, local governments have the autonomy to delay its implementation in certain zones or exclude other sites, provided they create valid local ordinances for such actions.
