Microsoft Faces Legal Setback as Patent Case Sanctions Denied by Court
In a recent development in the legal battle between Microsoft and Bill Ramey of Ramey LLP, a U.S. District Court judge has denied Microsoft's motion for sanctions. The judge analyzed communications from Eric Morehouse, the in-house attorney for CTD, indicating that there was at least implicit approval of Ramey’s conduct during the legal proceedings. Judge Rodriguez pointed out that 'the Court finds that Morehouse's conclusory declarations alongside these emails do not rise to clear and convincing evidence needed to show that Ramey disregarded CTD's instructions.'
This case stems from a lawsuit filed by Ramey in October 2022, alleging that Microsoft Azure and Microsoft Security infringed upon four patents held by CTD. The lawsuit was ultimately dismissed in August 2023, and an appeal was filed by Ramey the following month. Subsequently, Microsoft initiated motions for sanctions against Ramey in September 2023 and again in June 2024, seeking to penalize him for allegedly not adhering to his client’s directives.
