Fashion Nova Agrees to Settlement Following Accessibility Class Action Lawsuit for Blind Users

Fashion Nova Settlement Reached in Significant Class Action Lawsuit

In an important development for accessibility rights, Fashion Nova, Inc. has reached a settlement in a class action lawsuit centered around allegations that its website was not accessible to legally blind individuals utilizing screen reading software. The lawsuit, known as Alcazar v. Fashion Nova, Inc. (Case No. 4:20-cv-01434-JST), was filed in the Northern District of California, culminating in a class action settlement announced by CPT Group, Inc. on June 20, 2025.

Background of the Lawsuit

The complaint stemmed from claims that Fashion Nova's website, www.fashionnova.com, was incompatible with assistive technologies necessary for visually impaired users. According to the plaintiff, this limitation effectively excluded blind individuals from accessing the same shopping experience available to sighted customers. Fashion Nova, while denying any wrongdoing and asserting its commitment to customer inclusivity, ultimately agreed to a settlement to resolve the matter without prolonged litigation.

Who Benefits from the Settlement?

The lawsuit has resulted in the establishment of two certified settlement classes:
1. The Nationwide Class: All legally blind individuals who attempted to access Fashion Nova's website using screen reading software during the relevant time period, which stretches from February 26, 2018, to the final judgment.
2. The California Class: Specifically targets legally blind individuals in California who have tried to access the website using screen reading software during that same timeframe.

If you belong to either of these classifications, you are automatically included as a class member eligible for benefits from the settlement.

Settlement Amount and Accessibility Improvements

As part of the settlement, Fashion Nova has agreed to pay a total of $5.15 million and implement significant improvements to its website to enhance accessibility for visually impaired users. After covering the legal fees and administrative costs associated with the settlement, the remaining funds will be distributed among eligible California class members. Each individual who files a valid claim can receive a cash payment of up to $4,000; however, only one payment will be granted per household.

How to File a Claim

Class members who are part of the California group can access a Claim Form online or download it from the dedicated settlement website, www.FashionNovaAccessibilitySettlement.com. Submission can be completed either online or by mail, but all claim forms must be submitted by the deadline of October 20, 2025.

For those who do not wish to participate in the settlement, options include opting out of the settlement, which would allow for the possibility of pursuing separate legal action against Fashion Nova. Alternatively, if class members prefer, they can file an objection to the terms of the settlement with the court.

What’s Next?

A hearing to review and potentially approve the settlement has been scheduled for February 12, 2026. This hearing will provide a final opportunity for any arguments against the settlement to be made before Judge Jon S. Tigar. Members of the public are invited to attend, although attendance is not mandatory.
