Potts Law Firm Initiates Class Action Against Hendrick Health Over Data Breach Incident

Potts Law Firm Initiates Legal Action Against Hendrick Health Following Data Breach

In a significant legal move, Potts Law Firm has filed a class action lawsuit in Taylor County, representing Ada Louise McHenry, along with other impacted patients, against Hendrick Health and its healthcare technology vendor, Xsolis, Inc. This action comes on the heels of a serious data breach that is alleged to have compromised sensitive patient information.

The Incident

The data breach reportedly stemmed from a phishing attack affecting Xsolis, which provides case management services to Hendrick Health. According to the lawsuit, the breach occurred on January 22, 2026, and it may have exposed critical personal information, including patients' Social Security numbers, dates of birth, medical record numbers, treatment histories, and physician names.

The lawsuit claims that affected individuals were not informed about the breach until June 2026—over four months after the unauthorized access was first detected. This delay has raised serious concerns about the accountability of healthcare providers in protecting sensitive data and promptly notifying patients of breaches.

Patients' Trust Betrayed

Derek Potts, the National Managing Partner of Potts Law Firm, emphasized the vital trust patients place in healthcare providers when sharing personal information. He stated, “Patients trust healthcare providers with some of the most personal and sensitive information they have. When healthcare organizations collect that information, they have a responsibility to protect it and to promptly notify patients when a breach occurs.”

The lawsuit alleges that both Hendrick Health and Xsolis failed to implement reasonable cybersecurity measures necessary to safeguard patient data adequately. Furthermore, the lack of timely notification to affected patients is a primary concern, as it denies them the opportunity to take immediate protective actions against potential identity theft or fraud.

Legal Action Details

Plaintiff Ada Louise McHenry, who has been a long-term patient of Hendrick Health, claims that her personal and medical details were exposed in this breach. As a result, affected patients are now facing an increased risk of privacy infringements, including identity theft, medical information misuse, and financial fraud.

The proposed class action includes all individuals whose personal information was compromised due to the phishing attack involving Xsolis and Hendrick Health and who received a breach notification letter. In the lawsuit, McHenry and her legal team are seeking damages and injunctive relief for those impacted by this incident.

Recommendations for Affected Patients

Individuals who received notifications from Hendrick Health regarding the breach are advised to preserve all correspondence and actively monitor their financial and medical accounts to spot any signs of unauthorized activity.

The lawsuit, identified as `Ada Louise McHenry, individually and on behalf of all others similarly situated v. Hendrick Medical Center and Xsolis, Inc.; Cause No. 52545-A`, is set to be presented in the Taylor County District Court.
