National Wildlife Federation's Legal Action Against Harmful Rollbacks



On July 15, 2026, the National Wildlife Federation (NWF), along with five of its affiliates, took significant legal steps to protect wildlife by issuing a 60-day notice of intent to sue the U.S. Fish and Wildlife Service (FWS) and National Marine Fisheries Service (NMFS). This action arises from what they describe as reckless and illegal attempts by these agencies to roll back crucial habitat protections established under the Endangered Species Act (ESA).

The ESA has been instrumental for decades in safeguarding the habitat necessary for the survival and recovery of numerous species classified as endangered. The proposed changes pose a considerable risk, potentially leading to devastation for a variety of vulnerable species, including southern icons like the bobwhite quail and brook trout. Critically, these changes violate several federal regulations, including the Administrative Procedure Act, the National Environmental Policy Act, and the ESA itself.

Kristen Byrnes Floom, Public Lands Counsel for NWF, emphasized, “Wildlife cannot survive without the shelter, access to food, and safe places to rear their young that habitat provides.” She lamented that the elimination of the existing definition of harm undermines the essential objectives of the ESA to conserve at-risk species and the ecosystems they depend on. Floom urged the FWS to withdraw the new rule and fortify habitat protections amid an ongoing biodiversity crisis.
