Merrill Edge Retirement Account Holders: Important Class Action Notification

Important Class Action Notice for Merrill Edge Clients

On April 28, 2026, JND Legal Administration released an important announcement regarding a class action lawsuit involving Merrill Edge retirement accounts. The United States District Court for the Southern District of New York has certified a class following Valelly v. Merrill Lynch, Pierce, Fenner & Smith Incorporated, regarding the alleged failure to pay a reasonable interest rate on cash balances in customers' Merrill Edge self-directed retirement accounts. The cash balances were automatically swept into deposit accounts at banks affiliated with Merrill through the Retirement Asset Savings Program (RASP).

Who is Affected?

If you opened or possessed a Merrill Edge retirement account with cash balances during the designated period from December 15, 2016, to March 15, 2020, you may be part of this class action. To be considered a class member, you must have had at least one retirement account with such cash balances that were subjected to the RASP program.

Understanding Your Options

As a class member, you have two options regarding your participation in the lawsuit:
1. Do Nothing: By choosing this option, you will remain part of the class action and are bound by any resulting judgments, whether favorable or unfavorable. Remaining in the class also allows you to seek potential monetary recovery from any trial outcomes or settlements. However, in doing so, you relinquish the right to sue Merrill separately regarding similar claims.

2. Opt-Out: If you prefer not to be part of the class, you can exclude yourself from this lawsuit. By doing this, you will not be affected by any court orders and will maintain the right to pursue separate legal action against Merrill regarding these claims. To successfully opt out, you must write a letter requesting to be excluded from the class, stating your details, and mail it to JND Legal Administration by July 22, 2026.

Upcoming Trial Dates

A jury trial is currently scheduled to commence on October 13, 2026. If you need updates or want more detailed information, you are encouraged to visit MLRetirementAccountLitigation.com. The court has appointed Wolf Popper LLP as the Class Counsel. There is no need for individual class members to engage separate legal representation, as Class Counsel is working on behalf of all affected members.
