However, they subsequently refiled their complaint in California, sticking to their claim without acknowledging the prior proceedings.

The Los Angeles court's subsequent ruling revealed significant flaws in Pricaspian's approach to notification. For one, the court established that the notification done through publication was not executed in accordance with legal standards, resulting in the annulment of the judgment. The judgment heralded that Pricaspian had not complied with their obligation to provide notice within a designated timeframe, further cementing Homm's legal standing.

Due to the improper notification, Homm was left devoid of an opportunity to defend himself in the initial court proceedings. His co-defendant, Todd Ficeto, successfully had their case heard and was acquitted, primarily due to the court's conclusion that Pricaspian suffered no damages related to their claims against him. Since Homm was unable to present his defense at that time, he did not benefit from this ruling.

Expressing relief and satisfaction, Homm articulated, "This clarifies everything. Pricaspian did not have a legitimate claim against me, yet they pursued me in an unjust manner leading to a judgment that was rendered without fair representation. Had I been appropriately notified, I would have defended myself successfully. I am pleased that my efforts to annul this substantial judgment have been fruitful."
