Nevada Adopts ODG Drug Formulary to Support Evidence-Based Care in Workers' Compensation



The State of Nevada has recently passed a bipartisan measure to adopt the ODG Drug Formulary, an innovative tool aimed at enhancing the care provided in workers' compensation cases. This significant legislation, known as Nevada Senate Bill 317, was signed into law by Governor Joe Lombardo on June 10, 2025, following overwhelming support in both the Democrat-controlled State Assembly and Senate.

This new law mandates the Nevada Division of Industrial Relations (DIR) to implement the ODG Drug Formulary by January 1, 2027, making Nevada the thirteenth state in the U.S. to incorporate this evidence-based guidelines system. The ODG Drug Formulary is derived from the widely employed ODG Treatment Guidelines, which focus on safe and effective return-to-work strategies for injured employees.

The Implications of the ODG Drug Formulary


The adoption of this formulary represents a pivotal shift to a closed drug formulary system in the Nevada workers' compensation landscape. By emphasizing evidence-based medical practices, the formulary is designed not only to improve care but also to help achieve long-term cost containment. A noteworthy aspect of this change is that coverage for non-formulary drugs will continue until January 1, 2028, ensuring a smooth transition for healthcare providers and patients alike.
