Memphis Attorney Sues Schuerger Shunnarah Trial Attorneys for Illegal Solicitation

A Memphis attorney, Thomas Greer, has taken legal action against the national personal injury law firm, Schuerger Shunnarah Trial Attorneys. Greer has filed a lawsuit in Shelby County Circuit Court, accusing partners Alexander Shunnarah and Robert Schuerger of orchestrating an illegal solicitation scheme aimed at vulnerable car accident victims in Tennessee.

The lawsuit came to light when Greer represented Ben Daniel, a lawyer associated with the family-owned Daniel Law Firm. After being involved in a car accident, Daniel was contacted within a mere 48 hours by an individual who falsely stated they were representing a nonprofit medical organization. This caller went on to offer medical treatment and subsequently transferred Daniel to a representative of Shunnarah's firm, who allegedly applied undue pressure on him to sign a legal agreement.

According to Greer, the core of the lawsuit centers around the claim that Shunnarah’s team unlawfully accessed Daniel's confidential information, which is protected under Tennessee’s privacy laws. This information was reportedly obtained from a police accident report. Furthermore, the complaint alleges that the firm engaged in activities that violate state consumer protection regulations, legal advertising standards, and privacy laws. The actions of the defendants are also described as constituting a civil conspiracy.

In a statement, Greer emphasized the need for ethical practices within the legal field, stating, "The public deserves better than this. What we're witnessing is a playbook built on deception. Firms are employing aggressive and unscrupulous tactics to acquire clients, and such practices cannot continue due to their unethical and unlawful nature."

Ben Daniel also voiced his concerns regarding the issue, adding, "Having spent decades representing injury victims in Memphis, I understand how vulnerable individuals can be post-accident. Experiencing this illegal solicitation personally demonstrated just how predatory such operations have become. These deceitful tactics erode the integrity of our profession."

As a precautionary measure, Greer has referred this matter to the Tennessee Board of Professional Responsibility, aiming for a thorough examination of these concerns. He is also advising Tennesseans involved in accidents to ignore any unsolicited outreach and to choose their legal representation based on their own judgment.
