On April 7, 2025, Merchant & Gould proudly announced a major victory at the U.S. International Trade Commission (ITC), marking a significant milestone for GENERAC's MOTORTECH. The case revolved around MOTORTECH’s engine ignition systems that play a crucial role in various energy and industrial applications. In an exciting turn of events, the ITC decided to reject claims that MOTORTECH's products infringed on a competitor's patents, which ensures that MOTORTECH's innovative offerings remain available to U.S. consumers without any restrictions.

In February 2024, the ITC initiated an investigation based on a complaint that accused MOTORTECH of violating U.S. trade law. The allegations centered around accusations that MOTORTECH was importing ignition systems and components that encroached upon a rival’s patent related to capacitive discharge ignition systems. Furthermore, the complaint labeled MOTORTECH's products as “knock-off versions,” requesting that the ITC prohibit U.S. imports and domestic sales of the products in question.

In response to these claims, MOTORTECH firmly contested the accusations, showcasing evidence that demonstrated its patented products are fundamentally different from those of the competitor. A pivotal evidentiary hearing took place in late September, leading to an initial determination issued by the ITC's Chief Administrative Law Judge on January 28, which concluded that MOTORTECH’s ignition systems did not infringe upon the patent in question. This determination signified that MOTORTECH had not violated U.S. trade laws.

The investigation concluded on March 31, 2025, when the ITC declined to review the initial determination and ultimately terminated the case. Josh Hartman, who spearheaded the Merchant team during the trial, expressed gratitude for the opportunity to represent MOTORTECH, remarking that this decision not only vindicated MOTORTECH but also reinforced its reputation as an innovator within the engine ignition systems market.
