Public Health Advocates Challenge FDA's Policy on E-Cigarettes



A coalition of public health advocates, including pediatricians and concerned parents, has recently filed a federal lawsuit against the Food and Drug Administration (FDA). This legal action aims to contest the FDA's new enforcement policy that allows the marketing and sale of unauthorized e-cigarette and nicotine pouch products without undergoing the necessary scientific review and marketing authorization mandated by federal law.

The lawsuit, filed in the U.S. District Court for the District of Maryland, asserts that the FDA's enforcement guidance issued in May 2026 blatantly violates federal laws by allowing potentially harmful tobacco products to flood the market. This includes e-cigarettes and flavored nicotine pouches, which have been linked to increased nicotine addiction among youth. Notably, studies show that youth are particularly attracted to flavored varieties of these products.

According to the lawsuit, the FDA's guidance permits thousands of unapproved tobacco products to enter the market indefinitely, circumventing the safeguards set by the Tobacco Control Act. With the emergence of these products, there is growing concern about how they may undermine the progress made in reducing youth tobacco use over the past few years.
