National Police Association Backs Border Patrol Overtime Parity Act to Support Agents
The National Police Association (NPA) has recently voiced its strong support for the Border Patrol Overtime Parity Act (H.R. 10070), a piece of legislation introduced by Representative Andy Barr (KY-06) and co-sponsored by Representative John McGuire (VA-05). This act seeks to extend special overtime pay benefits to all U.S. Border Patrol agents, correcting disparities in pay that exist under current regulations. Under existing law, only GS-12 Border Patrol agents are eligible to receive a significant overtime payment of 50% on top of their basic hourly rate for any regularly scheduled overtime hours worked, as established under the Border Patrol Agent Pay Reform Act. Moreover, agents below the GS-12 grade currently receive a 25% overtime supplement for those scheduled 10-hour workdays. However, the Border Patrol Overtime Parity Act would notably eliminate the GS-12 limitation, thereby allowing agents at all levels to benefit from this enhanced overtime compensation.
This legislative move comes as Border Patrol agents consistently face brutal conditions and dangers inherent in their work, including threats from criminal organizations. Rejecting the notion that risks vary by pay grade, Paula Fitzsimmons, Legislative Director for the NPA, emphasized that Border Patrol agents are dedicated public servants, all committed to the unified mission of safeguarding our borders. "They should receive consistent overtime pay," she stated.
Despite U.S. Customs and Border Protection reporting higher hiring numbers and achieving a record-high agent count, the agency remains short of its goal of 25,000 agents, compounded by an impending wave of retirements that could strain manpower if recruitment and retention efforts do not keep pace. Fitzsimmons asserted, "Expanding special overtime pay to all Border Patrol agents will significantly help in recruitment, while also boosting the morale and retention of current agents."
Additionally, a related bill introduced earlier this year by Rep. Barr, known as the Border Patrol Supervisors Retention Act (H.R. 8956), aims to extend the special overtime benefits to agents classified as GS-13 through GS-15, who currently are not eligible for these additional payments.
