CME Group's Disciplinary Actions: A Closer Look at 2025 Trends and Insights

CME Group's Disciplinary Actions in 2025

In 2025, the CME Group featured a notable landscape of disciplinary activities, characterized by a decrease in aggregate monetary penalties reaching their second-lowest level since 2018. This trend, detailed in a recent report by Cornerstone Research, sheds light on the evolving dynamics surrounding regulatory enforcement within the financial markets.

According to the findings from the Trends in CME Group Disciplinary Notices 2018–2025, a total of 962 unique disciplinary notices were issued against market participants from 2018 to 2025. After a significant drop of 55% in such notices from 2019 to 2022, 2023 marked a reversal, with an 80% increase in notifications. The trend stabilized, resulting in 120 notices in 2024, followed by 127 in 2025, indicating a normalization of enforcement practices.

The report reveals that the CME Group imposed over $81 million in penalties during this eight-year period, comprising approximately $59 million in fines, $12 million in disgorgement, and $10 million in restitution. The reduction in aggregate penalties in 2025 primarily stemmed from alterations in the types of reported violations. A significant shift occurred with a marked decline in notices relating to Disruptive Practices Prohibited, historically the most commonly referenced violation. In 2025, these notices dropped to only seven, with associated penalties falling dramatically from $1.58 million in 2024 to $330,000 in 2025.

Nicole Moran, a co-author of the report and vice president at Cornerstone Research, elaborated, “Despite the overall number of disciplinary notices showing little change in 2025, we witnessed a considerable shift in the types of infractions being enforced. Notably, the categories of Providing and Keeping Records emerged much more frequently, signified by 31 notices issued that year.”

Even as the fines saw a decline, they were still evident across most notices, with 125 out of 127 carrying a financial penalty. The median non-zero fine decreased to $25,000 in contrast to an annual average of $40,000 recorded from 2018 to 2024. Similarly, the median non-zero restitution amount dropped to $16,007, quite a reduction from the preceding seven-year average of approximately $98,969.

Laurent Samuel, another report co-author and Cornerstone Research principal, offered insight into the concentrated nature of enforcement activities, noting that nearly half of the notices referred to multiple rules. Fines continued to be concentrated within certain categories, with four violations—Providing and Keeping Records, Member Coordination, Position or Margin Limit Violations, and Failure to Supervise Employees—accounting for nearly half of all fines.

A further analysis revealed that most enforcement actions resided in the latter half of 2025, with 60% of notices being issued in this timeframe, consistent with a back-heavy trend last observed in 2018 through 2020. Notably, financial products and energy derivatives showed a rise in disciplinary actions compared to their historical averages, with financial products implicated in 43 notices and energy derivatives in 36. Conversely, agricultural and metals products saw a decline in notices related to them compared to previous years.
