Fender Secures Copyright Protection for Stratocaster Body Design
In a landmark decision from the Düsseldorf District Court in Germany, Fender Musical Instruments Corporation (FMIC), based in California, has established substantial legal protection for its iconic Stratocaster® guitar body design under German and European copyright law. This ruling, delivered on March 9, 2026, empowers Fender to take legal action against the manufacturing, sale, and distribution of guitars that use the Stratocaster® body shape within Germany and the broader European Union (EU).
The court recognized that Fender has enhanced rights to protect its design in global commercial activities, regardless of the production location of the infringing products. This ruling stemmed from a case involving Chinese guitar manufacturer Yiwu Philharmonic Musical Instruments Co., which produced and sold electric guitars on the global e-commerce platform AliExpress for distribution to Germany. The court found that these products illegally replicated Fender's Stratocaster® body design, classifying it as an “applied art” work under German and EU law.

As a result, Yiwu Philharmonic is prohibited from producing, selling, or distributing guitars featuring the Stratocaster® body shape in Germany and the EU. Should violations occur, penalties can reach up to €250,000 per incident or a six-month imprisonment if fines are not enforceable, according to statutory limits.
