Atlantic Energy Resolves Inquiry by New York DPS



In a significant development, Atlantic Energy, a prominent provider of retail electricity and natural gas services, has successfully concluded an inquiry initiated by the New York Department of Public Service (DPS). This inquiry primarily centered on compliance with regulatory changes that took effect in April 2021. The resolution was achieved through collaborative discussions between Atlantic Energy and the DPS, alongside a comprehensive analysis of customer data that showcased the company's compliance measures.

The inquiry's conclusion comes after Atlantic Energy underwent leadership changes in the summer of 2023. Under the guidance of a new management team, the company has introduced stringent protocols to ensure adherence to all regulatory requirements and to prioritize the protection of its customers. It was during the discussions with the DPS officials that Atlantic Energy presented substantial evidence attesting to its rigorous compliance endeavors.

DPS officials acknowledged the proactive and transparent approach adopted by Atlantic Energy, stating that the company demonstrated a responsible means of addressing the complex regulatory landscape. As part of the settlement agreement reached with the DPS, Atlantic Energy has committed to providing restitution to customers affected by past noncompliance allegations. However, in a review of the customers analyzed, it was found that only half were owed restitution, while the remaining half had actually saved money by utilizing Atlantic Energy’s services over their respective utility providers.

Emily Cipes, the General Counsel for Atlantic Energy, expressed her satisfaction regarding the resolution, stating, "The resolution of this matter underscores our commitment to transparency, compliance, and delivering real value to our customers. We are grateful for the DPS's acknowledgment of our efforts and remain dedicated to maintaining the highest standards of service."

The management team has since transformed the company’s approach to focus on offering long-term fixed-rate products. This strategy aims to deliver price stability alongside enhanced customer satisfaction. CEO Rob Cantrell commented on the settlement, noting, "We need to make sure we are coloring within the lines. This settlement allows us to close the chapter on past issues and move forward with a clear focus on developing energy products that benefit our customers, all while maintaining the highest level of regulatory compliance."

Since its inception in 2012, Atlantic Energy has been a licensed supplier, providing competitive electricity in eleven states and natural gas in seven states, reaching over 50 utility clients. The company's suite of services includes innovative solutions for managing energy consumption effectively, catering to both residential and commercial clients.
