Summary Judgment

The court delivered a summary judgment on all counts in favor of Parrish Medical Center, underscoring that Deligdish's allegations lacked the necessary evidentiary support. This was not the first time Deligdish faced defeat in his legal endeavors against the hospital; his previous claims have similarly faltered due to a lack of credible evidence. Despite notifications from both the U.S. government and the State of Florida indicating their decision not to intervene in the proceedings, Deligdish pressed ahead with his lawsuit, which led to further dismissals of his motions.

The claims made by Deligdish included serious accusations against Parrish Medical Center, alleging violations of the False Claims Act (FCA), the Florida False Claims Act, and the Stark Act. Bloomberg Law reported on the court's findings, emphasizing that a whistleblower must provide sufficient record evidence to substantiate claims against health providers. In Deligdish's case, he failed to present a compelling argument that any false certifications were knowingly made by the defendants.

George Mikitarian, the President and CEO of Parrish Healthcare, expressed satisfaction with the court's ruling, emphasizing the hospital's focus on delivering safe and high-quality care to the community it serves. “Our responsibility to the families and individuals of North Brevard is to stay focused on providing high-quality and safe care for them. We're of course pleased with the court's ruling,” Mikitarian remarked.

The legal team representing Parrish Medical Center, Zumpano Patricios, also celebrated the judgment, characterizing it as an important milestone in the battle against unmerited allegations. Founding shareholders Joseph I. Zumpano and Leon N. Patricios acknowledged the significance of the victory, stressing that it serves as a cautionary example against filing unsupported allegations against healthcare institutions.

This ruling adds to a growing list of legal defeats for Deligdish against Parrish Medical Center. Earlier legal skirmishes saw Parrish successfully evicting Deligdish's company from its North Brevard office and securing over $1 million in damages for unpaid rent. Subsequent lawsuits filed by Deligdish were also dismissed, culminating in the most recent judgment reaffirming the hospital's steadfastness in defending its mission, integrity, and the confidence placed in it by patients and the community.
